English summary: Many states use public-private partnership instruments to attract funding for improving public service infrastructure. An example of such an instrument is concessions. Commonly used in Russia and Kazakhstan, these are contracts with private investors for the construction, modernisation, operation and re-transfer of public infrastructure objects. Legal discussion on PPPs and concessions in Russia and Kazakhstan is focussed on contract law, although the administrative law dimension is omnipresent. The attempts of these two transition states to establish anisland of stabilityfor complex, long-term projects in a rather unstable legal environment are examined and compared in this book. As a result, fundamental issues of civil, private and public administrative law are taken up and analysed. German description: In vielen Staaten bezieht die offentliche Hand zur Erfullung von Aufgaben der Daseinsvorsorge auch private Unternehmen ein. Azar Aliyev untersucht den Konzessionsvertrag als ein Instrument solcher offentlich-privater Partnerschaften im russischen und kasachischen Recht. Konzession ist in beiden Staaten gesetzlich als Vertrag uber Errichtung, Modernisierung, Betrieb und Ruckubereignung von offentlichen Infrastrukturobjekten durch Private definiert. Ebenso wie in Deutschland spielen dabei Privatrecht und offentliches Recht zusammen; allerdings liegt der Schwerpunkt der Diskussion in den untersuchten Staaten anders als in Deutschland nicht im Verwaltungs-, sondern im Privatrecht. Die Arbeit diskutiert die Konzession auch als Mittel, im Kontext eher labiler juristischer Infrastruktur Inseln der Stabilitatfur langfristige und komplexe Grossprojekte zu schaffen. Dabei werden viele Grundsatzfragen des Zivilrechts sowie des Wirtschaftsprivat- und Wirtschaftsverwaltungsrechts aufgegriffen und analysiert.
